Please read the Terms and Conditions carefully before purchasing. This website is operated by Swiss Hyper by Jansson, hereinafter referred to as “we”, “our”, “us”, or “Swiss Hyper”. The following general terms and conditions of sale has the intend to clarify and define the contractual relations between:

-and any legal or natural person, hereinafter referred to as the “customer”, “client”, “you” or “they”.
By purchasing product(s) through our website you agree to accept our Terms and Conditions. Swiss Hyper reserves the right to update and modify the general terms and conditions of sale at any time and without notice. The applicable terms and conditions the customer agrees to will be those in force on the date of the order by the customer. If you do not fully agree to our terms and conditions you may not make any purchase.
We reserve the right to refuse sales to anyone for any reason at any time. While taking all of the necessary precautions to provide accurate information and make the website as secure as possible, Swiss Hyper cannot be held responsible or liable for damage occurred during the use of our site. Our store is hosted by Shopify Inc. and deliveries are carried out with the Swiss Post.
All data appearing on the site are exclusive to Swiss Hyper and users are not allowed to reproduce, copy or modify the content, and in particular logos, icons or images without consulting with Swiss Hyper first.
Products
While the pictures displayed on our website are produced with high quality and are as accurate as possible, the characteristics of the products as well as the photos visible on the site are given only as an indication and cannot ensure perfect similarity with the product offered, especially colors might vary depending on which computer screen or in which light the product is shown in. Thus, colors cannot have any contractual value. In case of unavailability of a product, we will inform the client as soon as possible after a purchase have been made.
Prices and Rates
Swiss Hyper shall not be liable to the customer or any third person for any price change, modification, suspension or discontinuance of the product(s). Special prices during sales or promotions cannot be requested retroactively. Prices displayed on the website are without VAT included, thus, when customers have their product(s) delivered to their address outside EU, the customer will be responsible to pay the VAT and any potential additional costs of delivery such as custom fees and courier fees.
Swiss Hyper reserves the right to not deliver products whose prices are incorrect.
Our website can show prices and place orders in different currencies in order to make the user experience better for the customers. Swiss Hyper is not responsible or liable for any claim related to exchange rates. All currency exchange rates remain at customers expense.
The delivery costs will be added to the prices of the products during the check-out process and will be displayed before the customer finalize the purchase. Shipping costs are calculated according to the weight and volume of the order as well as the delivery address.
Purchase and Orders
A customer who aim to purchase a product on the Swiss Hyper website, is required to provide correct information and to go through the various stages of the purchasing process, this includes but are not restricted to identifying products, read the full description of the product, adding products to the shopping basket, provide delivery address and delivery method and choice of payment method. When the customer places the order the customer also accept the terms and conditions, and the customer confirm having full knowledge of them and decline their right to invoke its own terms and conditions of purchase or any other conditions. The confirmation of the purchase will be worth signature and acceptance of the operations carried out.
Payment of the order purchased on the website www.swisshyper.com is due at the time of ordering, payment is made by credit card (Visa or Mastercard) and Paypal.
Swiss Hyper has no access to confidential information relating to the payment. The information is fully encrypted.
Deliveries
Swiss Hyper delivers to all countries served by the Swiss Post and deliveries will be made to the delivery address that the customer specified during the ordering process.
Shipping costs are shown at the end of the ordering process and needs to be approved by the customer before the validation of the order. Shipping costs can vary depending on the weight of your package and the country of delivery.
Shipping costs
Shipping costs are at the expense of the client.
For deliveries of goods sold, deliveries are made on a DAP basis, meaning that the customer pay the VAT of the recipient country, as well as all customs duties. The client will be required to pay the carrier the import taxes (VAT of the recipient country). The client will also be required to pay for customs duties and any charges relating to their order that may be requested upon delivery.
Delivery times
The delivery times apply once the payment of the order has been registered with us, meaning when the payment have been successfully processed and delivered to Swiss Hyper, and the order has been prepared and deposited with Swiss Hyper’s delivery service provider. Swiss Hyper uses Swiss Post as their delivery provider, and their delivery times are around 1-3 working days for deliveries within Switzerland and around 7 – 14 days for other countries, exact days depend on the conditions of local post couriers.
Swiss Hyper may inform the client in case of delay in the delivery, however, Swiss Hyper cannot be held liable or responsible for any compensation for this delay.
Delivery
In the unlikely event of damage during the delivery on the product bought, the reasoned protest must be made within two days of delivery. Any complaint should be made to the customer service of Swiss Hyper, with clear images of the damage and damaged part(s).
Warranty for defected products and retraction
In accordance with Swiss law, for faulty/defect product, we will either repair or replace the product, and only cancel the purchase and reimburse the buyer the amount payed for the product(s) if the faulty product cannot be replaced or repaired. Swiss Hyper will not reimburse costs for shipping or any other costs that may occur. The time period for warranty claims are two years since the delivery of the goods to the buyer.
The warranty does not apply if:
-the jewelry has been broken, scratched, torn or soiled.
-repaired by an external service provider.
In case of a warranty claim, the client must provide the receipt of purchase in order for the warranty to be claimed and processed by Swiss Hyper.
The customer stands for all shipping and delivery costs when returning products of any warranty claims. When the product is repaired or replaced and due to be shipped to the customer, the customer is responsible for delivery and shipment costs.
Regardless of a warranty claim, the customer has a withdrawal period of 14 days from the delivery to their address. The customer must notify the customer service of Swiss Hyper of the return of the product for a refund or an exchange. The customer is responsible for the return of the product(s) and the customer is required to pay all expenses of shipping and delivery of the product, and the product must be returned in its original packaging.
In the case of a return the customer is required to contact Swiss Hyper’s customer service at info@swisshyper.com and send back the product(s) they wish to return and include the return document which you can find in the returns section on the website. In the return document the customer needs to include the order number, and also include the receipt of the purchase, as well as a request for an exchange or return.
Returns, Exchange and Refunds
There is a withdrawal period of 14 days from the delivery of the product sold, the customer has to notify Swiss Hyper of the exchange or refund. In the event of non-conformity of the product sold, Swiss Hyper’s warranty is limited to the return of the product, and refund of the product or exchange. The customer is hereby informed that the customer pays the costs of returning the product to Swiss Hyper, including shipping cost and any possible customs duties.
In case of return, email us first at info@swisshyper.com and inform us about the return, with a description of the product or products concerned. Then the jewelry has to be returned by the customer unworn and unopened in its original packaging (for hygiene and safety reasons), and the customer must include the receipt of the purchase, the return label, and a request for a refund or an exchange. Swiss Hyper will process the refund within 15 days after the returned product has been received by Swiss Hyper. The return will be transferred to the payment method used by the customer when placing the order on this website.
Liability and Warranty
Swiss Hyper is run through Shopify and all necessary precautions to ensure secure and reliable access has been taken, however, Swiss Hyper cannot under any circumstances guarantee that there will not be any technical deficiencies, material errors or other unintended errors.
Swiss Hyper cannot be held liable for any damage in relation to using this website.
Intellectual Property Rights
All data, specifically logo’s, images, icons, audio, video clips, graphics and texts which appears on this website, are all protected and you must not use them without our consent.
Personal Data Protection
On this website, the collected data of customers is treated confidential and Swiss Hyper undertakes to comply with the legislation, in particular the data protection and ethical rules. Swiss Hyper uses cookies to make your visit on this site more interactive.
You have the right to withdraw your consent at any time and object the processing of your personal data, to do so, contact info@swisshyper.com.
Applicable Law and Jurisdiction
Swiss Hyper is based in Switzerland and the relationship between the client and Swiss Hyper is there for governed by the Swiss law. In case of any dispute in relation to the relationship between the client and Swiss Hyper, the place of jurisdiction is the registered address of Swiss Hyper.
